TERMS AND CONDITIONS

Welcome to the website of Kinetic Intent ("Company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website and our professional call centre, outbound telemarketing, inbound customer service, and lead generation services (collectively, the "Services").

1. SCOPE OF SERVICES

Kinetic Intent provides outsourced business-to-business (B2B) and business-to-consumer (B2C) customer support, appointment setting, data verification, and lead generation services. The specific scope, deliverables, pricing, and performance metrics for any campaign will be governed by a separate, binding Service Level Agreement (SLA) or Statement of Work (SOW) executed between Kinetic Intent and the client.

2. COMPLIANCE WITH INTERNATIONAL CALLING REGULATIONS

As a UK-based entity operating globally, Kinetic Intent strictly adheres to international telemarketing, consumer protection, and electronic communication regulations. Both Kinetic Intent and its clients agree to jointly uphold these legal frameworks.

3. CLIENT WARRANTIES AND LEAD REPRESENTATION

If a client provides Kinetic Intent with data, the client warrants that all data has been collected lawfully, that explicit prior express written consent (PEWC) has been obtained, and that numbers are not on national suppression lists.

4. INDEMNIFICATION

The client agrees to defend, indemnify, and hold harmless Kinetic Intent from and against any third-party claims or regulatory actions arising from breaches of data privacy or calling regulations.

5. CALL RECORDING AND MONITORING

Kinetic Intent records calls for quality assurance, training, and compliance. By engaging our services, clients acknowledge that calls will be recorded and that appropriate disclosures are active on all lines.

6. LIMITATION OF LIABILITY

Total aggregate liability for any claim shall not exceed the total amount paid by the client to Kinetic Intent in the three (3) months preceding the event giving rise to liability.

7. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of England and Wales.
